For seven years, buying land in Uttarakhand was relatively open. A 2018 amendment had removed the size limit on land outsiders could buy, and hill plots changed hands quickly for resorts, homes, and farms.

That window closed in February 2025. The state cabinet approved a stricter land law on February 19-20, and the Assembly passed it on February 21. The changes rewrote the Uttarakhand land purchase rules for anyone without state domicile, and they tightened the process for everyone.

Rule 1: No Farmland for Outsiders in 11 Districts

This is the headline change in the new Uttarakhand land purchase law. If you don't hold Uttarakhand domicile, you cannot buy agricultural or horticultural land in these 11 districts:

  • Almora, Bageshwar, Chamoli, Champawat, Dehradun, Nainital, Pauri Garhwal, Pithoragarh, Rudraprayag, Tehri Garhwal, and Uttarkashi

Haridwar and Udham Singh Nagar are the two exceptions. Even there, the rules are tighter than before:

  • Permission to buy farmland now comes from the state government, not the district magistrate.
  • Before buying land up to 12.5 acres, the concerned department must issue a requirement certificate for the intended purpose.

What it means for you: If you dreamed of an orchard farmhouse in Mukteshwar or Ramgarh, that route is closed unless you inherit the land or buy a property registered before the new law.

Rule 2: A 250 sqm Residential Limit, Once in a Lifetime

Outside municipal areas, a buyer from another state can purchase up to 250 sq m (about 300 sq yards) of land for residential use. The key conditions:

  • It's allowed once in a lifetime.
  • It applies per family, so you can't split purchases between a spouse, parent, or child to get around the cap.

Inside municipal areas, the rules differ. Non-residents can buy residential and commercial property within municipal corporation and urban development limits, but land use there is strictly controlled (see Rule 4).

Rule 3: A Mandatory Affidavit for Every Purchase

Every buyer from outside the state must now submit an affidavit at the time of purchase. It declares that neither you nor your family owns residential land in Uttarakhand beyond the permitted limit, and it states the purpose of the purchase.

This is the enforcement tool behind Rule 2. A false declaration puts the land itself at risk.

What it means for you: Keep records of any land your family already holds in the state. Your lawyer will need them to draft an accurate affidavit.

Rule 4: Use the Land as Declared, or Lose It

The new law is strict about land use. If land is used against its approved purpose, or transferred without proper permission, it can be vested in the state government.

Two points stand out:

  • Within municipal limits, land must be used strictly for its designated purpose.
  • Commercial, industrial, or institutional land must be put to use within three years. If it isn't, the transaction can be voided and the land can revert to the state.

What it means for you: Never buy agricultural land hoping to "convert it later" without the proper process. And if you're buying for a business, have a realistic timeline to start.

Rule 5: State-Level Approvals and a Tracking Portal

This new rule for property sale in Uttarakhand changes who decides. District magistrates can no longer personally grant permission for land purchases. Approvals now move to the state level, and DMs must report land transactions and submit periodic reviews to the Revenue Council and the government.

  • Institutions such as schools, hospitals, and hotels can lease agricultural or horticultural land for up to 30 years, with extensions possible.
  • Uttarakhand domicile holders are not bound by the outsider restrictions, though they still face land-use rules and state-level approvals.

How to Buy Safely Under the New Rules

  1. Confirm your eligibility. Are you domiciled? Does your family already own land in the state?
