Residential Land: Yes, Up to 250 Square Metres

A non-resident may purchase up to 250 square metres of residential land without seeking anyone's permission. Roughly 2,690 square feet, or about 300 gaj.

Two qualifiers matter. The allowance is once in a lifetime, and it attaches to the family rather than the individual.

Commercial Land: Yes, Up to 500 Square Metres

A larger ceiling applies to commercial acquisition, reflecting the different economics of commercial use. The same verification discipline applies.

Agricultural and Horticultural Land: Closed in Most of the State

Non-residents cannot buy agricultural or horticultural land across eleven of Uttarakhand's thirteen districts.

Only Haridwar and Udham Singh Nagar remain open, and even there the process routes through state-level approval rather than a district decision.

Notice which places sit on the restricted list:

  • Mussoorie is in Dehradun.
  • Nainital, Bhimtal and the entire Jim Corbett area fall under Nainital district.
  • Rishikesh straddles Dehradun and Tehri Garhwal.

Effectively every hill destination a buyer from outside the state is likely to be considering.

Parcels in these areas are still routinely marketed as farmhouse land. The listing description does not change the record.

Trust, but Verify

Buying agricultural land as a non-agriculturist makes the transaction voidable. The state can cancel your title after payment, after registration, and after construction. A registered sale deed does not protect a purchase the buyer was never eligible to make.

Courts have been reinforcing rather than relaxing this. In May 2026, the Uttarakhand High Court held that prior state government sanction is mandatory for transferring land to a society for non-agricultural purposes even when the transfer happens by gift deed.
